Holiday Sickness Claims

Holidays are precious times for all of us. It gives us an opportunity to relax and create wonderful memories with our friends and family, so the last thing you expect is to fall ill or suffer from food poisoning abroad which can ruin your entire holiday experience.
Unfortunately, in most cases, the symptoms of suffering with sickness whilst abroad can persist for weeks or even months after returning home, so it is not just your holiday that gets ruined – it could also impact your life back at home.
Here at 1Solicitors, we’re able to assist you throughout your entire holiday illness claim with 24/7 legal support and a dedicated team of qualified and knowledgeable solicitors, always on-hand whenever you need them.

What type of holiday illness can I claim for?

If you have been unfortunate enough to suffer from food poisoning or any other type of illness whilst on a package holiday in the last three years, you could be entitled to thousands of pounds in holiday sickness compensation.
Our specialist legal solicitors can help you claim the maximum compensation you deserve as quickly as possible, aiding with your recovery when you land back at home.

Package holiday claims

To find out if you are eligible, we need to see if your holiday booking was sold as a package holiday by the tour operator. A package holiday must contain a combination of at least two of the following components;

  • Transport
  • Accommodation
  • Other tourist services & activities which account for a significant portion of the package

The vast majority of package holidays sold in the UK are covered by the “Package Travel Regulations” therefore you are most likely covered. However, it can also include customised holidays where you have selected separate components. By law, the package holiday that you’ve paid for must be what you’re expecting.

How much compensation am I entitled to?

The amount of compensation we can achieve for your holiday illness claim for you depends on the type of symptoms you have suffered from, and how long those symptoms persist.
Generally, the more severe your symptoms are and the longer it takes for you to recover, the higher the amount of compensation you could be awarded.
Food poisoning abroad
You don’t have to be severely ill in order to make a claim. A mild case of food poisoning with symptoms lasting for about a week or more could mean that you are entitled to compensation.
Below are the average holiday sickness compensation amounts for food poisoning:
Mild to Moderate Food Poisoning: £1,000 to £8,000
Severe Food Poisoning: £8,000 to £35,000
